Shuttle Mediation in Family Law Matters
I have seen some of the most ingrained family law conflicts resolved at mediation over the last decade. Mediation is a process whereby both parties involved in the dispute agree to attend at or with a neutral, independent third party who acts as an intermediary in helping parties arrive at a mutually agreed resolution.
The parties remain empowered by retaining control over any family law agreement which is entered into. A family law mediator cannot impose a decision on the parties or decide the outcome, that is not their role as a family law mediator.
When mediation in family law matters is first raised, parties often picture everyone sitting around a large table together in a board room, trying to reach a family law agreement. This not what happens in a shuttle mediation. In a shuttle mediation in family law cases, the parties generally never see or hear each other. In a shuttle mediation, parties and their representatives raise their respective contentions with the mediator in the absence of the other party to the dispute. The mediator then takes those contentions to the other party, in the absence of the first party. Each party in the family law mediation participates via a seperate room or location.
While shuttle mediation has traditionally been used to resolve family law conflicts where tensions are high or there are other issues such as domestic violence, either before or after divorce or separation, it can also have a myriad of benefits for parties whom remain relatively amicable in family law matters. Shuttle mediation in family law cases can prevent the parties from becoming sidetracked on periphery issues which might have occurred during the relationship or which might not be directly relevant to the family law dispute at hand. A shuttle mediation in family law cases allows each side to remain focused at all times on resolving the family law dispute in a safe environment in which each party participates, but is physically distanced and absent from the other party throughout the family law mediation process.
