Ploughing Around the Stump
Many of you have probably heard of the old Farmer’s adage that life is simpler when you just plough around the stump. In family law conflicts, all too often I see other parties letting themselves become embroiled in aspects of the family law dispute which are often counter-productive in reaching resolution. If people are not very careful during a family law dispute, they can become distracted from the real issues, often resulting in delays in resolution and adverse cost outcomes.
Following on from my recent post about difficult conversations, the best family lawyers I’ve seen over the last decade are the ones who regularly have uncomfortable or hard conversations with their clients about not becoming embroiled in disputes that have no bearing on determining the legal questions at hand.
Family Law Court Judges are extremely busy people. In my experience, they value articulate and concise facts and evidence being put before them. Doing this often allows them to very quickly assess and determine the relevant issues. Clients often think every argument they want to advance or respond with is important and relevant. This is often not the case. Lawyers should not act as a mere mouthpiece for their clients and do not serve them by doing this.
A client who can exercise the greatest restraint from being drawn into disputes on irrelevant or non-consequential matters during any family law dispute is often on the simplest trajectory to resolution. They are usually able to achieve freedom, peace and move on with life the quickest.
